Terms of Service

These terms set out the agreement between you and Pixalera — what you can expect from the platform, what we expect from you, and how billing, content ownership and platform API rules work.

Section 01

Acceptance of Terms

By accessing or using Pixalera ("the Service") you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These Terms apply to all visitors, creators, teams and contributors.

Section 02

Description of Service

Pixalera is an AI-first social media management platform that lets you schedule content, manage ideas, automate Instagram and Facebook direct messages, connect social channels, view analytics and monetise your audience. The Service includes our web application, APIs and related tools.

We may modify, suspend or discontinue any part of the Service at any time. Where a change materially affects paid features, we give advance notice.

Section 03

Account Registration

To use Pixalera you must create an account. You agree to:

  • Provide accurate, current and complete registration information
  • Keep your account information updated
  • Keep your password confidential and secure
  • Notify us immediately of any unauthorised use of your account
  • Be responsible for all activity that happens under your account
  • Only connect social accounts you are authorised to manage

Section 04

Acceptable Use

You agree not to use the Service to:

  • Violate any law, regulation or third-party right
  • Publish spam, misleading content or content that breaks platform policies
  • Send unsolicited bulk direct messages or otherwise abuse messaging APIs
  • Distribute malware, viruses or harmful code
  • Attempt unauthorised access to our systems or other users' data
  • Harass, abuse or harm any person
  • Misrepresent your identity or affiliation
  • Circumvent rate limits or access controls on connected platforms

Section 05

Platform & API Terms

YouTube Terms of Service

By using YouTube features through Pixalera you also agree to the YouTube Terms of Service at youtube.com/t/terms.

Google Privacy Policy

Google's privacy policy at policies.google.com/privacy applies to data collected through YouTube APIs.

Meta Platform Terms

Instagram and Facebook automations run on the official Meta APIs and are subject to Meta's Platform Terms and messaging policies.

Minimum scopes

Pixalera accesses platform data only on your behalf and requests the minimum scopes needed for the features you enable.

Content responsibility

You are solely responsible for content published through Pixalera; it must comply with each platform's guidelines, copyright rules and applicable law.

Revoking access

You may revoke Pixalera's access at any time from your Pixalera settings or directly from the platform's connected-apps settings.

Google API Services User Data Policy

Pixalera's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. We do not use Google user data for advertising and never sell it.

Section 06

Content Ownership

You retain ownership of all content you create and upload to Pixalera. By uploading content you grant us a limited, non-exclusive licence to store, process and transmit that content solely to operate the Service on your behalf.

You are solely responsible for ensuring you hold the rights to any media, music or third-party material you publish through Pixalera.

Section 07

Plans, Billing & Renewals

Pixalera offers a free plan and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis and processed securely via Razorpay.

Auto-renewal

Subscriptions renew automatically unless cancelled before the renewal date.

Refunds

Subscription fees are non-refundable except as required by law or as stated in our Refund Policy at /refund-policy.

Pricing changes

We give active subscribers 30 days' notice before any price change takes effect.

Taxes

Prices are shown in INR and may attract GST or other applicable taxes at checkout.

Section 08

Intellectual Property

The Pixalera name, logo, platform design, source code and all related intellectual property are owned by Pixalera. You may not copy, modify, distribute or create derivative works without our express written permission.

Section 09

Suspension & Termination

You may cancel your account at any time. We may suspend or terminate accounts that breach these Terms, abuse platform APIs, create security or legal risk, or fail to pay for a paid plan.

On termination, your right to use the Service ends immediately. We delete your data in line with the retention periods in our Privacy Policy.

Section 10

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, AND WE ARE NOT RESPONSIBLE FOR ACTIONS TAKEN BY THIRD-PARTY PLATFORMS THAT AFFECT YOUR CONNECTED ACCOUNTS.

Section 11

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXALERA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING LOSS OF CONTENT, REVENUE OR ACCESS TO CONNECTED SOCIAL ACCOUNTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Section 12

Governing Law

These Terms are governed by the laws of India. Any dispute arising from these Terms is subject to the exclusive jurisdiction of the courts in India.

Section 13

Changes & Contact

We may update these Terms from time to time and will notify you of significant changes by email or in-app. Continued use after changes constitutes acceptance of the updated Terms.
